You like the name. Make sure it's yours to keep.

MyIPO refuses similar marks, not just identical — and the fee won't refund.

What "checking the name" actually means

Four, and only four

Identical

Identical-mark search

Finds exact matches. Searching "Apple" finds "Apple."

Similar

Similar-mark search

Finds near-misses — "Apel," "Appel" — that MyIPO can still refuse.

Availability

Availability

Whether the name is free, against what's already on the register.

Registrability

Registrability

Whether it can be registered at all. Generic words can't be, free or not.

+ every package covers one class — a café that also sells branded T-shirts needs two

The outcome that reads as bad news

What it looks like

The search comes back and finds a conflict with your name.

What's actually true

That's the win — it happened before the non-refundable government fee did.

The cheapest moment to find a conflict is now — every later moment costs more.

And the decision still isn't transferable

No search, ours or anyone's, can promise MyIPO will agree. The risk of being wrong stays priced into the filing fee, not into whoever you hired to search.

MyIPO does not refund the government fee if it refuses your application. So a RM 600 search protects RM 950 to RM 1,050 per class of non-refundable fee — which is the whole reason All-in-One is the recommendation rather than the upsell.

The one question that decides this

Anyone can tell you the name is free. Telling you it isn't registrable is the harder part.

What the search covers

This month, a trademark agent and OCTIS run the identical searches and can both file with MyIPO; the difference only shows up in how the class you file under gets chosen.

What happens after the opinion

What they do well

A trademark agent runs the same searches and can tell you the name isn't registrable.

What their shape can't reach

That opinion usually closes the file. On the OCTIS Business Lawyer Plan, trademarks are already one of six covered areas — so a later question about the same mark doesn't open a new engagement. It answers questions about your mark; enforcement stays a separate service.

When you find out decides the cost

MyIPO is the Malaysian government office that approves or refuses trademark applications, and does not refund its filing fee if it refuses.

1

In the search

The search fee, and nothing else

2

At examination

The government fee — spent, and MyIPO doesn't refund it

3

After launch

A rebrand: packaging, signage, the domain, the name customers already know

4

After someone enforces

All of the above, plus a claim

Same conflict, four different prices, depending only on when it's found.

One class, or two

Trademarks are filed under one of 45 numbered classes, grouped by the type of goods or service — for example, Class 43 covers restaurants and Class 25 covers clothing.

Every package covers one class. What you actually sell decides how many you need.

What All-in-One actually costs

The total below adds OCTIS's search-and-filing fee to the separate government fee MyIPO charges to examine the trademark application.

All-in-One search & filing, per classRM 1,300
MyIPO government fee, per classRM 950–1,050
What All-in-One actually costs, per classRM 2,250–2,350

Per class, not per application — and both lines are due before MyIPO looks at your file.

A true ladder — pick by how far along you are

The three packages differ in how much they check and file, matching how far along you are — from still brainstorming a name to ready to file it with MyIPO.

Where you arePrice
Basic — still brainstorming namesRM 99/class
Comprehensive — actively launchingRM 600/class
All-in-One — ready to secure it nowRM 1,300/class + gov't fees

Per class

Every price above is per class — a two-class business pays twice.

What each tier adds

Basic: identical search + availability/registrability. Comprehensive adds the similar-mark search and a risk read. All-in-One adds filing with MyIPO.

Government fees

Additional to every filing price, and non-refundable.

Government fees are paid directly to MyIPO, per class, and are additional: RM 950 per class if your goods and services are on MyIPO's Pre-Approved List, RM 1,050 if they are not. How the specification is drafted decides which applies, and that drafting is part of what you are buying.

Not covered

  • A comprehensive search does not include filing with MyIPO
  • MyIPO does not refund the government fee on refusal, regardless of who filed
  • A word mark and a logo mark are two separate registrations, priced separately
Which package should I pick?

Basic if you're still brainstorming names. Comprehensive once you're actively launching — it adds the similar-mark search and a risk read. All-in-One when you're ready to secure the name now — it adds filing with MyIPO.

Why isn't an identical-name search enough?

MyIPO also refuses marks it considers confusingly similar, not just identical ones. A name can pass an identical search cleanly and still fail examination.

Does the price include the government filing fee?

Government fees are paid directly to MyIPO, per class, and are additional: RM 950 per class if your goods and services are on MyIPO's Pre-Approved List, RM 1,050 if they are not. How the specification is drafted decides which applies, and that drafting is part of what you are buying.

What happens if the search finds a conflict?

It did its job. Finding it now costs the search fee. Finding it after you file costs the non-refundable government fee instead — and finding it after you've launched costs a rebrand on top.

Is there a money-back guarantee?

No seal on this one — the deliverable is an opinion, not an outcome, and an honest "this won't register" is exactly what you're paying for. OCTIS's published 30-day money-back guarantee covers two specific services; see the guarantee page for which ones.

Every week you keep using this name, it gets more expensive to stop.

Check it in one class first. If it's a problem, better to know now.
